Drug Testing

How do you know if a person is covered by the Federal Random Drug testing rule…

Ask the following questions:

 

A.  Is the person an employee or employer?

Answer: Employee

What form of transportation is it?

Answer: School Bus

B. Does this person operate a truck or a bus:

1.       With a gross vehicle weight of 26,000 or more

2.       With the capacity to carry 16 or more passengers (including the driver), or

3.       Of any size that is used to transport hazardous materials which require the vehicle to be placarded.

Answer: You might answer yes to a couple of these…

C.  Does the job function require the person to hold a commercial Driver’s License in the United States?

Answer: Yes

 The person is subject to drug & alcohol testing regulations under:

•         FMCSA (49 CFR part 382) and

•         DOT (49 CFR part 40)
