Question:

Is a school district required to advertise a position opening?


Answer:

There is no state or federal law prohibiting hiring without advertisement of the position.  However, the best practice is to have a written hiring policy that states the district will always advertise openings, and to follow that practice.  If challenged, a court will look at whether the hiring practice was discriminatory.  One way a district would prove it was NOT discriminatory, is to have followed written hiring policy that requires advertisement.
